Collection of Information

We collect personally identifiable information, like names, postal addresses, email addresses, credit card information etc., when voluntarily submitted by our members and/or visitors. The information you provide is used to fulfill your specific request, to improve the experience on our web site, and to ensure a successful experience at Cycle614. Cycle614 may also log non-personally-identifiable information including IP address, profile information, aggregate User data, and browser type, from Users of the site. This data is used to manage the Website, track usage and improve the Website services. This non-personally-identifiable information may be shared with third parties to provide more relevant services and advertisements to Users. User IP addresses are recorded for security and monitoring purposes. We may also record information about your usage, such as when you use the Cycle614 website. If you are logged in, we may associate that information with your account. We may use clear GIFs (a.k.a. “Web Beacons”) in HTML-based emails sent to our Users to track which emails are opened by recipients. We may also use a User’s email address to send updates, a newsletter or news regarding Cycle614. Users may choose not to receive email of these types by following opt-out instructions contained in such email. Cycle614 reserves the right to send you important notices about your account even if you opt out of all voluntary email notifications.

Liability Waiver 

Cycle614 is not responsible in any way for the safekeeping of your personal belongings while attending a class. Classes at Cycle614 may be physically strenuous and that you voluntarily participate in them with full knowledge that there is risk of personal injury or property loss. Neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Cycle614 or its members for any personal injury or property damage/loss whether caused by negligence or otherwise.

Children Under Age 13

We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please DO NOT attempt to register on our website or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on our website. In the event that we learn that any personal information has been submitted to the website from a child under age 13, we will delete that information as quickly as reasonably possible. Children Between the Ages of 13 and 18

If you are between the ages of 13 and 18, you may register on our website only with the involvement of a parent or guardian.
 

Medical

Client Risks

1. Medical Recommendations. Client should consult with his or her physician or have a physical examination before using any of Cycle614's facilities or enrolling in any of the Cycle614's classes, especially if client is elderly, pregnant, has a history of heart disease, high blood pressure or other chronic illness, or is unaccustomed to physical exertion or has other physical limitations.

  1. Client is strongly encouraged to request and take advantage of the free initial orientation (including bike fitting) and ongoing support available to ensure the proper and safe use of all of the Cycle614's equipment.

  2. Client Conduct. Client shall not use any Cycle614 facilities, service or equipment in such a way as to endanger the health or safety of Clients or others. Client shall be responsible for any property damage or personal injury caused by Client or his or her guests. Client agrees not to violate any laws while in Cycle614.

  3. Activity Risk. Any strenuous athletic or physical activity involves certain risks. Client and his or her guests assume the risk of any and all accidents or injuries of any kind that may be sustained by, or in connection with, use of Cycle614's facilities. Cycle614 cannot guarantee that any facility or equipment is free of risk. Client agrees to use care in the use of Cycle614's facilities, equipment and services and to protect against accidents by other clients.

  4. Medical Disclaimer. Client has been informed and acknowledges that the Cycle614 makes no claims as to medical or fitness results that can or may be obtained through use of the Cycle614's facilities, equipment or services. Cycle614 has neither suggested nor will suggest any medical treatment to Client. Only licensed medical professionals are qualified to give medical advice.

  5. Client's  Health Warranty. Client represents that: (i) there are no medical or physical conditions that would preclude his or her use of the Cycle614's facilities; (ii) he or she has not been instructed by any physician not to use Club; and (iii) he or she is in good health and has no disability, impairment, injury, disease or ailment preventing him or her from engaging in active or passive exercise or which could cause increased risk of injury or adverse health consequences as a result of exercise.

  6. Client Release and Indemnity. By checking the box to signify agreement with the Terms and Conditions Agreement and/or by attending classes or otherwise participating in Cycle614's activities, Client hereby acknowledges and agrees that there are inherent risks in indoor cycling and exercise and in using the equipment associated with the Cycle614s classes or instruction. Client assumes full responsibility for his or her use of Cycle614's facilities and shall indemnify Cycle614's owners and employees, against any and all liability arising out of the use of the facilities. Additionally, Client and his or her guests shall hold Cycle614 harmless from any loss, theft, cost, claim, injury, damage or liability incurred as a result of Cycle614 use and client activities.

  7. Prevailing Party. In the event Client  commences an action against Cycle614 or its owners and/or employees and fails to obtain judgment or partial judgment in Client's favor, Client shall be liable to the Cycle614 for all costs and expenses associated with Cycle614's defense of the action or any claims on which Client did not prevail, including attorney’s fees and costs.

  8. Costs of Collection. Client agrees to pay all costs plus reasonable attorney’s and collection fees in connection with Cycle614 (or Club’s designee’s) collection of any amounts owed by Client.

  9. Loss of Property. Client is urged not to bring valuables onto Cycle614's premises and to keep valuables with him or her at all times. Cycle614  shall not be liable for the disappearance, loss or theft of, or damage to, personal property (including money, negotiable securities and jewelry).
